Terms & Conditions

These terms and conditions apply to the use of this website: partington.com.au . By placing an order through the website, you agree to be bound by these terms and conditions.

1.Partington Advanced Engineering Pty Ltd is a registered company. You agree to abide by the terms and conditions contained below.

2. Partington Advanced Engineering Pty Ltd is a composite centric multi material engineering firm that specialises in light weighting products

3. The products under the terms of this agreement are the 39R Front Bicycle Wheel and the 44R Rear Bicycle Wheel.

4. Ordering From Us

4.1 Where the customer requests to be added to the waiting list, the customer agrees to pay the fees set out as follows:

    • Non-refundable deposit to gain access to the product waiting list;
    • Balance of payment for the product including import duties and associated shipping costs.

4.2 If you proceed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

4.3 Acceptance of a deposit order allocates a place in our production schedule with current lead time projected at 16weeks from time of order.

4.4 The balance of payment is required once your order is ready for despatch. We will send you a ‘ready for despatch’ notice by email. Your order will be released once full payment is made. Failure to make balance payment and complete your order within 30 days will be considered a termination of contract and your order will be cancelled.

4.5 We may refuse to accept an order:

    • where goods are not available;
    • where we cannot obtain authorisation for your payment;
    • if there has been a pricing or product description error; or
    • if you do not meet any eligibility criteria set out in our terms and conditions.

5. Privacy

5.1 The customer acknowledges that Partington Advanced Engineering Pty Ltd will be required to collect personal information of consumers who order products including but not limited to name, contact details and credit card payment details. Partington Advanced Engineering Pty Ltd warrants that it will only use the information collected for those purposes of securing the orders for the products.

6. Default

6.1 If the customer is in default under our agreement, we may send you a default notice. The notice will tell you what the default is and what you are required to do to correct the default. You will have 14 business days to rectify the default.

6.2 If you do not comply with the default notice, being payment of the balance owed for the product ordered, the deposit paid by you will not be refunded.

6.3 You also agree to pay on default all costs and expenses incurred in exercising our rights of recovery from you and the guarantor if any and indemnify us against any losses resulting from the default.

7. Pricing / International Pricing

7.1 All payments on www.partington.com.au are collected in Australian Dollars (AUD). The price shown is inclusive of Australian goods and service tax (GST) at 10%. This tax will be deducted at checkout for international orders.

7.2 The price you pay will be converted by your credit card company/PayPal at their exchange rates from your normal card/PayPal account currency and may include charges so please check terms and conditions of your card issuer and/or PayPal before proceeding.

7.3 The payment includes free world-wide shipping, however we do reserve the right to cancel the order if shipping to your address is excessive and unforeseen, however this is very rare and we will do all we can to avoid this as obviously we want to support our customers.

8. Taxes and Import Duties

8.1 Prices indicated are inclusive of Australian Goods & Service Tax (GST) at a rate of 10% and is applicable for all domestic transactions (Australia).

8.2 Customers outside of Australia may be subject to import duties, local courier admin fees and taxes, which may be applied once a shipment reaches your country. Please note: we are legally required to declare the full value of goods (not including shipping charges) on all international packages, and shipments may be subject to import duties and taxes, which are applied once a delivery reaches your country. It is a criminal offence to falsify the details on this form. We cannot inaccurately describe the contents, claim a lower value or mark as a gift. Please do not ask or expect us to do any of the above. For details of Customs charges please consult your own customs authorities for the latest rates.

8.3 Please be advised that some courier companies that we use may allow you to pay for import/custom charges after the order has been delivered to you. This is standard procedure for these companies to ensure that your order is delivered to you as soon as possible and not delayed in customs. These charges are solely dependent on your local customs office and the courier company, Partington Advanced Engineering Pty. Ltd. cannot control these charges. For more information and advice, it is best to contact your local customs authority.

8.4 Partington Advanced Engineering Pty. Ltd. are not able to bear any customs or import duty costs. These must be paid by the customer; unfortunately, we have no jurisdiction over these charges and cannot predict what they may be. We are unable to reimburse any costs incurred regardless of the circumstances so do please ensure you are fully aware of these costs before placing your order. Please contact us if there are any questions we may be able to help with.

9. Delivery

9.1 The customer shall receive delivery of the product to their nominated address provided when placing the order for the product.

9.2 The costs for delivery to the nominated address will be paid by the customer and is required to be paid to Partington Advanced Engineering Pty Ltd prior to the delivery of the product.

9.3 The customer shall indemnify and keep indemnified Partington Advanced Engineering Pty from any claims arising in the event that the product incurs any damage during the delivery process or is not received by the customer due to an error or omission by the delivery agent.

10. Cancelling and order before dispatch

10.1 If you wish to cancel your order before it has been dispatched, you can notify us by email. If you have already made final payment your goods may have been dispatched, in this instance, your order cancellation will be processed as a return, and subject to those same conditions.

11. General Returns Information

11.1 To process any returns and subsequent refund, please ensure your item reaches us within 14 days of us providing you with a Returns Number (process outlined below). Please note we cannot accept responsibility for items lost in transit so we advise using a recorded method and may request proof of delivery. Refunds will have deducted initial order deposit, postage, duties and any third-party handling fees. Refunds may take up to 28 days to process but we will always endeavour to process them as quickly as possible.

12. Returning unwanted items after dispatch or delivery of goods

12.1 If you wish to cancel an order or return an unwanted item for a refund when goods have already been dispatched or delivered please contact us email. The costs of returning goods to us shall be incurred by the customer.

12.2 Please Note: Do not just send your goods back to us without contacting us first.

12.3 The rights to return the goods to us as referred to above will not apply in the following circumstances:

    • If the product has been used
    • The packaging of the product has been excessively damaged
    • The product is damaged in anyway
    • The product is not in full resalable condition
    • Goods Faulty on Arrival, Incorrect or Damaged in Transit

12.4 If your goods are faulty on arrival, incorrect or damaged in transit they should be reported to us by email or phone no longer than 7 days of receipt. When the goods have been returned to us and the fault has been verified, we will issue a refund or send a replacement as required.

13. Goods suspected faulty during use

13.1 If any product purchased from Partington Advanced Engineering suffers from what you suspect to be a manufacturing fault within 2 year of the delivery date, then please email including all available supporting information and pictures where possible. On receipt, the returned goods will be inspected and if found to be faulty will either be refunded or replaced (if available). Refunds will not be made for goods which fail because of reasonable wear and tear.

14. Dispute Resolution

14.1 The parties shall endeavour to settle any dispute arising out of or in relation to this agreement, including with regard to its existence, validity or termination, by mediation administered by the Australian Disputes Centre (ADC) before having recourse to arbitration or litigation.

14.2 The mediation shall be conducted in accordance with the ADC Guideline for Commercial Mediation operating at the time the matter is referred to the ADC.

14.3 This clause shall survive the termination of this agreement.

15. Disclaimer

15.1 While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. We may make changes to the material on this Website, or to the products and prices described in it, at any time without notice. The material on this Website may be out of date, and we make no commitment to update such material.

15.2 The material on this Website is provided “as is” without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, we provide you with this Website on the basis that we exclude all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill) which but for these terms and conditions might have effect in relation to this Website.

16. Governing Law and Jurisdiction

16.1 This Agreement, including terms and conditions there-in, is governed by and interpreted in accordance with the laws applicable to the State of Victoria, Australia. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Victorian courts.
